A class action lawsuit is brought at the federal level when the claim at stake is in excess of $5,000,000; if the involved plaintiffs are citizens of a state different from the defendant; if any of the involved plaintiffs are citizens of a foreign state and the defendant is a citizen of a US state or if any plaintiff is a citizen of a US state and a defendant is a citizen of a foreign state.
State Level Class Action Lawsuits
In some cases a class action lawsuit that involves multiple states is brought to court under a single state’s law and the court extends its jurisdiction to include all plaintiffs in other states and sometimes internationally. This can be done as long as the defendant or defendants are within the jurisdiction of the state court.
