A class action lawsuit, also known as a representative action, is a lawsuit brought before the court by an individual, a group or a company on behalf of a larger group of individuals with similar or equivalent problems or grievances. A class action lawsuit is generally brought in the case that more individuals have suffered in a similar manner and the cost of bringing the case to court is too costly or impractical for a single person.  In this case, a class action lawsuit is filed on behalf of the entire group.  Because class action lawsuits aggregate a much larger amount of individual lawsuits into a single suit, they save the plaintiffs’ time and money as well as significant time and expense for the state and federal court systems.

Federal Level Class Action Lawsuits

A class action lawsuit is brought at the federal level when the claim at stake is in excess of $5,000,000; if the involved plaintiffs are citizens of a state different from the defendant; if any of the involved plaintiffs are citizens of a foreign state and the defendant is a citizen of a US state or if any plaintiff is a citizen of a US state and a defendant is a citizen of a foreign state.

State Level Class Action Lawsuits

In some cases a class action lawsuit that involves multiple states is brought to court under a single state’s law and the court extends its jurisdiction to include all plaintiffs in other states and sometimes internationally.  This can be done as long as the defendant or defendants are within the jurisdiction of the state court.
